These Terms of Service ("Terms") govern your access to and use of Escal8 (the "Service"). By using the Service, you agree to these Terms.
1. The Service
Escal8 enables you to create and operate customized AI agents that can be connected to WhatsApp and web channels. You can upload materials ("Content") to tailor responses and define your brand tone.
2. Your Account & Responsibilities
You are responsible for your account, the Content you upload, and for complying with applicable laws. You must obtain necessary rights and permissions to process end-user data and to use third-party platforms (e.g., Meta/WhatsApp).
3. Acceptable Use
You may not use the Service to engage in unlawful, misleading, or harmful activities; to infringe others' rights; to distribute malware; or to violate platform policies (including Meta's terms for WhatsApp). Do not use the Service to impersonate people, manipulate vulnerable users, conceal automated participation where disclosure is required, or make final automated decisions about legal, medical, financial, employment, or similarly consequential matters.
4. Subscriptions & Billing
Paid plans are billed in advance and renew only when the checkout, dashboard, order form, or signed quote clearly identifies the plan as recurring. Before a recurring plan begins, the applicable commercial surface must state the price, billing frequency, minimum commitment if any, renewal terms, and cancellation method. Fees are non-refundable except where required by law or stated in the applicable agreement.
You may cancel a future renewal through the self-service account control provided for the plan or by sending written notice to legal@escal8.tech. A plan started through self-service will not require a sales call to cancel. Cancellation stops future renewal and normally takes effect at the end of the current paid period. We provide renewal, trial-ending, and price-change notices when required by applicable law or the customer agreement.
5. Intellectual Property
You retain ownership of your Content. We and our licensors retain all rights to the Service. You grant us a limited license to process your Content solely to provide the Service.
6. AI Disclosure and Safety
Customers must identify automated participation where required and configure knowledge limits, tool permissions, testing, monitoring, correction, and human escalation appropriate to the workflow. AI output may be inaccurate, incomplete, or inappropriate and must not be presented as qualified medical, legal, financial, or emergency advice.
A workflow that detects possible self-harm, suicide, violence, or immediate danger must stop its ordinary commercial or support flow, avoid harmful instructions, state its limits, offer locally appropriate emergency or crisis options, and transfer to a trained human when that route is available. Escal8 is not an emergency service and must not be presented as one.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. You are responsible for reviewing outputs and configured actions before relying on them, subject to rights and obligations that cannot lawfully be excluded.
8. Limitation of Liability
To the maximum extent permitted by law, Escal8 will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
9. Termination and Data
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Eligible customer content, uploaded documents, and derived indexes can be exported or deleted under the applicable agreement and our Data Deletion process. Billing, tax, fraud-prevention, security, dispute, and protected backup records may be retained where reasonably necessary or legally required.
10. Changes
We may modify these Terms. Updates take effect upon posting. Your continued use of the Service constitutes acceptance.
11. Governing Law
These Terms are governed by applicable laws of your place of establishment or, if none, the laws of the jurisdiction where Escal8 is organized, without regard to conflict of law principles.
